By accessing, streaming, downloading, citing, or otherwise using the podcast, articles, research, newsletters, images, and accompanying materials published on this site (collectively, "the Content"), you accept the terms set out below. These terms operate alongside, and do not displace, the default position at law: under the Copyright Act 1968 (Cth), all rights in the Content are reserved.
Ownership
All Content—including audio recordings, written articles, research, scripts, interviews, music, artwork, photographs, logos, and branding—is the intellectual property of Dr Robert N. Winter ("the Owner"), save where third-party material is used under licence or in reliance on fair dealing, in which case attribution is provided within the work itself.
Permitted Use
You may, without seeking further permission:
- Access, stream, and download the Content for personal, non-commercial use.
- Share hyperlinks to publicly available Content, provided the link directs the user to the original source as published on robert.winter.ink or its authorised syndication partners.
- Quote the Content for the purposes of criticism, review, parody, satire, research, scholarship, or the reporting of news, consistent with the fair dealing provisions at sections 40 to 42 of the Copyright Act 1968 (Cth), provided that sufficient acknowledgement—author, title, date, and source URL—is given in accordance with ordinary scholarly convention.
- Cite the Content in academic and professional work, with proper attribution to Dr Robert N. Winter and a link to the original source where applicable.
Prohibited Use
Save as expressly permitted above or with the prior written consent of the Owner, you may not:
- Copy, reproduce, adapt, translate, modify, distribute, publish, or create derivative works from the Content in whole or in substantial part.
- Use the Content for commercial purposes, including advertising, sponsorship, promotion, or monetisation, whether direct or indirect.
- Host, mirror, redistribute, or otherwise make the Content available on any platform or medium other than robert.winter.ink and its authorised syndication partners.
- Remove, alter, obscure, or falsify any copyright notice, trademark, authorial attribution, or proprietary marking associated with the Content.
- Misattribute, distort, abridge, edit, or otherwise manipulate the Content in any manner that could mislead the reader or damage the reputation of the Owner.
- Compile, aggregate, index, or incorporate the Content—whether with other material or alone—into any collection, database, anthology, or derivative corpus intended for distribution, sale, or public access.
- Use the Content, in whole or in part, to train, fine-tune, ground, evaluate, benchmark, or otherwise develop any machine learning model, large language model, generative artificial intelligence system, or comparable automated system, whether by direct ingestion, retrieval-augmented generation, automated scraping, vector embedding, or any other technical means. This prohibition applies irrespective of whether the developer is a commercial entity, an academic institution, a research laboratory, or an individual, and operates as an express reservation of rights for the purposes of any statutory or regulatory regime that recognises such reservation, including Article 4(3) of Directive (EU) 2019/790 on Copyright in the Digital Single Market.
- Use automated tools—including but not limited to crawlers, scrapers, headless browsers, and AI agents—to access the Content in a manner inconsistent with the site's
robots.txtfile or any published machine-readable restriction.
Members and Paid Subscribers
Access granted to members of the Commons (free membership) and the Inner Circle (paid membership) is governed by the separate Terms of Service applicable to each tier. In the event of any inconsistency between this Agreement and those Terms, the Terms of Service prevail in respect of the subscription relationship. Nothing in this Agreement excludes, restricts, or modifies any right of a consumer under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) where that right cannot lawfully be excluded.
Revocation and Modification
The Owner reserves the right to revoke, amend, or restrict the rights granted to the general public under this Agreement at any time, with or without notice. Continued access to or use of the Content after any such change constitutes acceptance of the amended terms. Any revocation or variation affecting paid members of the Inner Circle will be given effect in accordance with the applicable Terms of Service and the Australian Consumer Law.
Disclaimer and Liability
The Content is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Owner disclaims all warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose, and non-infringement. The Owner accepts no liability for direct, indirect, incidental, consequential, or exemplary loss or damage arising from the use of or reliance upon the Content. Nothing in this clause excludes, restricts, or modifies any liability that cannot be excluded at law, including under the Australian Consumer Law.
Governing Law and Jurisdiction
This Agreement is governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia sitting in Sydney.
