Disclaimer

This Disclaimer applies to robert.winter.ink and the podcast On the Subject of Leadership with Dr Robert N. Winter (together, "the Site"), including all articles, newsletters, marginalia, podcast episodes, associated social-media channels, and correspondence relating to them. It should be read alongside the Terms of Service, the Content Licence, and the Privacy Policy, each of which forms part of the agreement between you and me.

Views and Opinions

The views expressed on the Site, in the podcast, in associated social-media channels, and in private correspondence are mine alone. They are not attributable to any board, committee, employer, client, university, or other organisation with which I am, or have been, associated in a professional or academic capacity.

Where guests appear on the podcast, the views they express are their own and are not attributable to me, to their respective employers, or to any organisation with which they are associated. The appearance of a guest on the podcast does not constitute endorsement of their views, and it does not imply agreement with any position they adopt.

Nature of the Content

The Site publishes long-form writing and commentary on leadership, governance, organisational life, history, philosophy, and related subjects. It is intended for an educated adult readership and is offered for general information, intellectual engagement, and professional reflection.

The Content is not legal advice, financial advice, investment advice, medical advice, tax advice, accounting advice, actuarial advice, or any other form of regulated professional advice. It is not a substitute for advice given by a qualified professional on the particular facts of a particular matter, and it should not be relied on as such. Readers with specific questions affecting their personal, professional, or fiduciary position should consult a suitably qualified adviser.

In particular, articles and podcasts that discuss corporate governance, directors' duties, fiduciary obligations, regulatory responsibilities, or organisational strategy are not advice on the application of any of those matters to a specific board, company, or engagement. Any reader contemplating action on such matters should obtain independent legal and professional advice.

No Consulting Relationship

Reading the Site, subscribing to any of its tiers, corresponding with me, or engaging with the podcast does not establish a consulting, advisory, or other professional relationship between us. A professional relationship is formed only by the execution of a separate written engagement agreement.

Accuracy and "As Is"

While I take care to ensure that the Content is accurate, well-researched, and properly attributed, I make no warranty of accuracy, completeness, or reliability. The Site is provided on an "as is" and "as available" basis. I expressly disclaim all warranties, whether express or implied, including warranties of fitness for a particular purpose, merchantability, and non-infringement, and I do not warrant that the Site will be free of technical faults, interruptions, or security vulnerabilities.

Nothing in this Disclaimer excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded at law, including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

Third-Party and Linked Content

The Site contains links to external websites, embedded references to third-party works, and quotations from, or summaries of, third-party publications. I do not control third-party content, cannot warrant its accuracy, reliability, or continued availability, and do not endorse it by the fact of linking to or referencing it. You access third-party content at your own risk.

Affiliation, Sponsorship, and Paid Placement

The Site does not carry advertising, does not accept sponsored content or paid placements, and does not use affiliate links. No author, publisher, product, service, or organisation referred to in the Content has paid, or provided anything of value, in consideration for being mentioned. Where the Content refers to products or services—for example, the tools used to produce the Site—this is done for transparency or utility, not for commercial benefit.

If this position changes, it will be disclosed prominently in the relevant article and in a standing note on this page.

Authorial Work and the Use of AI

Articles, newsletters, podcast scripts, and podcast narration are my own authorial work in the sense that matters: I stand behind the reasoning, I am accountable for the meaning, and the judgements expressed are mine. My position on authorship in the age of AI is set out at length in Authorship in the Age of AI, and this Disclaimer should be read consistently with it.

I use artificial-intelligence tools routinely and without apology—as a thinking partner for interrogating ideas, as a research assistant for locating and summarising sources, and as a copy editor for matters of clarity, rhythm, and grammar. In this I am in step with standard practice in the senior professions: top-tier law firms, consultancies, and academic environments increasingly treat competent, disclosed use of AI as an expected part of good professional craft, and treat its avoidance as a lapse in that craft rather than a virtue.

What does not change is where authorial responsibility sits. The reasoning behind what is published is mine, the judgement that selects and rejects is mine, and the moral burden of belief that Friedrich's account of reasoned elaboration describes is mine. AI tools enlarge the workshop; they do not hold the chisel.

Where guests appear on the podcast, the words they speak are their own.

Evolving Views

The opinions expressed on the Site reflect my views at the time of publication. Those views may evolve as new information becomes available, as I revisit a question, or as circumstances change. Readers should regard each piece as a snapshot of my thinking at the date of publication, and should consider that date when assessing the relevance of a piece to any present question.

Corrections and Updates

Where my views on a topic change significantly and I revisit it in a subsequent article, an editorial note will be placed at the top of the earlier piece linking to the update. The earlier piece will remain unchanged in substance, so that the historical record is preserved and the evolution of my thinking can be tracked. Minor corrections—typographical errors, broken links, or updated references—will be made in place without separate notice.

Changes to This Disclaimer

I may revise this Disclaimer from time to time to reflect changes in the Site, the services used to operate it, or applicable law. The date of the most recent revision appears at the foot of this page. Where a change is material, I will notify registered members by email and post a prominent notice on the Site before the change takes effect. Minor or clarificatory changes will be published without separate notice.
